Your privacy rights

Newman Ministry LLC, along with our affiliates and subsidiaries (collectively, “Newman”, “us”, “our”, or “we”) knows that our users (“you”, “your”) care about how your personal information is used and shared, and we take your privacy seriously. This Privacy Policy explains how information about you is collected, used, and disclosed by Newman when you download, install, register with, access or use our websites, mobile applications and our other online products and services. Our privacy policy remains the same whether you (A) visit https://newmanministry.com, https://connection.newmanministry.com, and https://www.called.app/ (the “Websites”), (B) download the Newman Connect or Called mobile applications, (the “Apps”); (C) join our marketing campaigns and promotions, provided, however SMS marketing campaigns shall also be subject to any SMS Terms and Conditions located on our Websites, or (d) fill out any survey or questionnaire. Together, the Websites, Apps, marketing campaigns and promotions, data, services, products, information, tools, functionality, updates and similar materials provided through each are referred to collectively as the “Services”. All other terms and provisions associated with the Services will be provided to you in the Terms of Use located at https://newmanministry.com/terms-of-use/, which is incorporated into this Privacy Policy by reference.

Please read this policy carefully to understand our policies and practices regarding your information and how we treat it. By using our Services, you acknowledge that you accept and agree to the practices and policies outlined in this Privacy Policy.

Please note that this Privacy Policy does not apply to third-party websites or services (collectively, “Third-Party Services”), such as Facebook, Twitter, Pinterest, You Tube, which we do not own or control, even if you access them through our Services. We encourage you to carefully review the privacy policies of any Third-Party Services you access, so that you know how they will use your information.

We reserve the right to update the Privacy Policy at any time, and those changes will be posted here. Please review our Privacy Policy from time to time, so you are aware of its terms.  By continuing to use our Services, or any other legal method of consent, you agree to be bound by the terms of the updated Privacy Policy.  Please refer to the “Last Update” date below to see when this policy was last updated. You may not use our Services if you do not agree to the terms of this Privacy Policy, you may not use our Services.

What Information Newman Collect?

The information we collect from you falls into two categories: personally identifiable information (“Personal Information”), non-personally identifiable information (“Non-Personal Information”), and aggregate information. The Privacy Policy covers all of these types of information and tells you how we might collect, store, process, disclose, share, and/or use each.

Personal Information we may collect from you includes:

  • Name;
  • Address
  • Phone Number;
  • Email Address;
  • Demographic information, such as age and gender;
  • Religious affiliation;
  • Username;
  • Educational information, including the name of your high school and/or college/university (or anticipated college/university);
  • Geographic Location, when combined with other personal information;
  • Device identifiers, including mobile devices, such as UDID, MEID, and IMEI;
  • Text, images, messages, comments, photographs and/or videos (“User Content”) submitted and/or posted by you through the Apps and/or Websites will be stored in our servers and other users of the Websites and/or Apps will be able to see it, along with any other information that you choose to make public through your profile; and
  • Other personal information volunteered by visitors during registration processes or through your use of the Websites and/or Apps.

Non-Personal Information may also be recorded about our users and collected into groups so that it no longer reflects or references an individually identifiable user. Some examples of this are as follows:

  • IP Address;
  • Geographic Location;
  • “Cookie” Information from cookies that we use (both session and persistent cookies), and from cookies that we allow third parties to place on your device(s);
  • The website address, if any, that linked you to our Websites and/or Apps;
  • The website address, if any, you visit after our one or more of our Websites; and
  • Other anonymous site usage data.

Aggregate Information is anonymous, non-identifying, and aggregate information, such as the date and time of any request, language preference, referring website, the pages you visit within our Websites, the websites you go to after visiting our Websites, and domain name of your internet service provider.

Financial Information.  Although it may appear that we collect financial information from you on the Services, it is actually collected and processed through a third-party service provider (“Payment Processor”) to process payments for applicable Services.  The Payment Processor may collect financial information such as banking information or credit card number, name, CVV code or date of expiration, from you on the Service.  We do not hold, or have access to, your financial information.

How Does Newman Collect Information?

We are constantly trying to make your experience the best possible. In order to provide the Services, improve upon, or offer additional product or service offerings, we may collect information in the following ways:

Information We Collect Directly From You.

  • Communications You Initiate with Us: If you contact us by phone, email, live chat, Contact Us form, social media, or by some other means (either through our Services or through Third-Party Services), we may keep a record of your contact information and correspondence for later reference to help improve our Services to you.
  • Information you provide by filling out forms or registering an account on our Websites or Apps. This includes information provided at the time of registering to use our Websites and/or Apps, posting material and/or User Content, or requesting further services or assistance.
  • User Content uploaded by you through the Services. You may provide User Content through the Apps; you control how and when the User Content is uploaded to the Apps. You agree that any User Content you provide shall not be pornographic, lewd or otherwise likely offensive, in Newman’s sole discretion, and we reserve the right to refuse access to our Services to any user who provides such User Content.
  • Surveys, questionnaires, contests, or sweepstakes offered by Newman, and/or its third-party contractors and completed by you.

Information We Collect Through Our Communications with You. When we send you emails, we may track whether or not you open them, so we can determine the best ways to peak your interest. If you do not want to receive email or other communications from us, please contact us at privacy@newmanministry.com.

Third-Party Services. Our Websites may contain links to other websites, applications and services maintained by third parties. Some parts of our Services can be integrated (if you choose to enable this feature) to other web-based accounts you have with third parties such as your Facebook, Pinterest, or Twitter account. If you link to any of these Third-Party Services from our Services, we may collect some information about your use of those Third-Party Service(s). We will only be able to collect the information if you’ve authorized the Third-Party Service to provide us with that information or if you’ve made the information public. Additionally, if you mention us through your Third-Party Service, we may collect information and content related to your comment that is publicly available. If you wish to limit the information available to us, you should be sure to manage the privacy settings of your Third-Party Services. One thing we will never store is your Third-Party Services password.

Other Ministry Data.  To the extent that you are using the Called App in connection with another educational institution or campus ministry (collectively, “Other Ministries”), we collect the data that you provide in connection with those Other Ministries.

Information We Collect Automatically

Whenever you interact with our Website(s) and/or App(s), we may automatically receive and record information on our server logs from your browser including your IP address, “cookie” information, usage and log information, and the page you requested.

  • Cookies. “Cookies” are identifiers we store on your local browser or hard drive of your computer or mobile device that allow us to recognize your browser and tell us how and when pages in our Websites are visited and by how many people. You may be able to change the preferences on your browser to prevent or limit your computer or other device’s acceptance of cookies, but you may be unable to access and/or use certain parts or features of our Websites and Apps. Unless you have adjusted your browser setting so that it will refuse cookies, our system will issue cookies when you direct your browser to our Websites.  Our Services use Google Analytics, provided by Google LLC, 1600 Amphitheatre Parkway, Mountain View, CA 94043 (“Google”).  Google Analytics uses cookies and similar technologies to collect and analyze information about use of the Services and report on activities and trends.  Google Analytics may collect information regarding the use of other websites, apps and online resources.  For more information on how Google uses data when you use our Websites or Services, please follow this link: https://policies.google.com/technologies/partner-sites.  You may be able to opt-out of some or all of Google Analytics features by downloading the Google Analytics opt-out browser add-on, available at, https://tools.google.com/dlpage/gaoptout.  For more information about interest-based ads, or to opt out of having your web browsing information used for behavioral advertising purposes, please visit http://optout.aboutads.info.
  • Flash Cookies. Certain features of our Websites and Apps may use cookies stored outside of your browser (or Flash cookies) that may be accessed by multiple browsers on the same computer to collect and store information about your preferences and navigation to, from and on our Websites and Apps. Flash cookies are not managed by the same browser settings as are used for browser cookies. To disable or delete Flash Cookies, go to the Flash Player Setting Manager located on your computer or other personal devices’ control panel.
  • Other technologies such as “log files,” “pixel tags” or “web beacons”. When you access our Websites and Apps, our servers automatically record information sent from your browser, which may include your web request, Internet Protocol address, domain names, referring Uniform Resource Locator, browser type, browser language, and operating system; the date and time of your request and access; and Cookies that may uniquely identify your browser (collectively, “Usage Data”). We may combine Usage Data with Personal Information in a manner that enables us to trace Usage Data to an individual user, and may collect, use, preserve and disclose Usage Data in any manner that we may collect, use, preserve and disclose Personal Information as provided herein (whether Usage Data is combined with any Personal Information or otherwise). In addition, pages of our Websites, Apps, and our e-mails may contain small electronic files known as web beacons (also referred to as clear gifs. pixel tags and single-pixel gifs) that permit us, for example, to count users who have visited those pages or opened an e-mail and for other related Website statistics (for example, recording the popularity of certain Website content and verifying system and server integrity).  We may also use Meta Pixel, a web analytics and advertising service provided by Meta Inc. (“Meta”) on our Services. With its help, we can keep track of what users do after they see or click on a Facebook or Instagram advertisement, keep track of users who access our Services or advertisements from different devices, and better provide advertisements to our target audiences. The data from Meta Pixel is also saved and processed by Facebook. Facebook can connect this data with your Facebook or Instagram account and use it for its own and others advertising purposes, in accordance with Facebook’s Data Policy, which can be found at https://www.facebook.com/about/privacy/ and details Meta’s use and disclosure of such information, including, but not limited to its third-party service providers.   • Third Party ID. We may allow you to use your IDs from third-party website providers, including, without limitation, Google, Apple and/or Facebook ID, to set up an Account. If you wish to use these accounts you are taken to the applicable third-party website to login to your account and this information is then shared with us for the sole purpose of setting up your Account.

You can typically remove and reject cookies from our Websites with your browser settings. Many browsers are set to accept cookies until you change your settings. If you remove or reject our cookies, it could affect how our Websites and/or Apps work for you.

Third Party Use of Cookies and Tracking Technologies.

Third-Party Services, whose links are located on our Websites, may use cookies alone or in conjunction with web beacons or other tracking technologies to collect information about you when you use our Services. The information they collect may be associated with your Personal Information or they may collect information, including Personal Information, about your online activities over time and across different websites and other online services. We do not control these third parties’ tracking technologies or how they may be used. This Privacy Policy does not cover the use of cookies by any Third-Party Services. If you have any questions about Third-Party Services, an advertisement or other targeted content, you should contact the responsible provider directly.

Why Does Newman Collect Information and How Does Newman Use the Information We Collect?

We use information that we collect from and/or about you, including Personal Information to perform Services for you, to pursue our legitimate interests, and for other purposes, including:

  • To provide our Services and their content to you and allow you to review our services, create an account or profile or register for services on the Websites and Apps;
  • Part of our Services offered through the Apps and/or Websites involves collecting, storing, processing and otherwise using of User Content uploaded by you;
  • We may also use Personal Information to communicate with you about new offers, features, products or services or to improve the services that we offer;
  • To provide you with customer support and communication, and notices about your account including, but not limited to, through push notifications on your mobile device;
  • To facilitate the optional integration with Third-Party Services, if you choose to enable this feature;
  • To pay for our Services, though your financial  information will only be seen and/or used by our Payment Processor;
  • To verify that you are old enough to use our Services;
  • For analytical purposes, which may include generate and analyze statistics about your use of the Services for operational and/or security purposes, measurement of effectiveness of our marketing activities, performance improvements, research, testing and other business purposes;
  • To promote the security of our Websites and Apps by verifying accounts and activity, investigating suspicious activities and enforcing our Terms of Use and policies to the extent necessary for our legitimate interests in promoting the safety and security of the systems and applications used by our Services and to protect our rights and the rights of others;
  • To develop and improve our Services;
  • To conduct marketing research, advertise to you, provide personalized information about us on and off our Website and to provide other personalized content based upon the Services we provide to you to the extent it is necessary for our legitimate interest in advertising our Services or, where necessary, to the extent you have provided your prior consent, including without limitation, through requests made by you or use of built-in convenience features of the Services (e.g., push notifications) we provide to you;
  • To send you (even if you are affiliated with Other Ministries) marketing information, service recommendations and other non-transactional communications about us and our affiliates and partners, including information about our Services, promotions or events as necessary for our legitimate interest in conducting direct marketing or to the extent you have provided your prior consent, including without limitation, through requests made by you or use of built-in convenience features of the Services we provide to you;
  • To cooperate with public and government authorities, courts or regulators in accordance with our legal obligations under applicable laws to the extent this requires the processing or disclosure of Personal Information to protect our rights or is necessary for our legitimate interest in protecting against misuse or abuse of our Services, protecting personal property or safety, pursuing remedies available to us and limiting our damages, complying with judicial proceedings, court orders or legal processes or to respond to lawful requests.
  • In any other way we may describe when you provide the information; and
  • For any other purpose with your consent.

How Do We Share Your Information?

We may disclose Personal Information that we collect or you provide as described in this Privacy Policy as follows:

  • To third parties for the purpose for which you provide it. Newman provides an online community for high school students, college students and their respective colleges and universities to connect with such educational institutions’ campus ministries and members of such ministries. In providing the Services, Newman may provide your User Content, and other Personal Information, to other users and/or educational institutions and Other Ministries in connection with providing the Services;
  • To Other Ministries that may provide information of interest to you;
  • To contractors, service providers and other third parties we use to support our business service providers. We may share Personal Information collected through our Services with companies that perform services on our behalf, including companies that provide website development, hosting, payment processing and billing services;
  • To a (potential) buyer or other successor in the event of, or in relation to, a merger, divestiture, restructuring, reorganization, dissolution or other sale or transfer of all or any portion of Newman assets, whether as a going concern or as part of bankruptcy, liquidation or similar proceeding, in which Personal Information held by Newman about our Websites and/or Apps users is among the assets transferred;
  • To our affiliated entities, including, our subsidiaries, to whom this Privacy Policy also applies, so that we may provide you with marketing information, service recommendations, and other non-transactional communications about us;
  • To comply with any court order, law or legal process, including to respond to any government or regulatory request. We may disclose your personal information when we believe disclosure is appropriate to comply with the law or respond to a court order or subpoena; to prevent or investigate a possible crime, such as fraud or identity theft; or to protect the rights, property or safety of ourselves or others. We reserve the right to report to appropriate law enforcement, governmental authorities and other third parties any activities that we, in good faith, believe to be harmful or unlawful, with or without providing notice to you;
  • To enforce or apply our Terms of Use and other agreements; and
  • If we believe disclosure is necessary or appropriate to protect the rights, property, or safety of Newman, our users and others for purposes of fraud protection and credit risk reduction.

Non-Personal Information. In order to improve our Services, we may share Non-Personal Information collected on our Services with our service providers. Additionally, we may combine aggregate information such as pixel tags, web beacons, or cookies as discussed above with similar data we collect from other visitors to help us improve our Services, provided that such aggregated data is anonymous and cannot be linked back to any individual. We may also disclose such aggregated, anonymized information and data that does not identify you or any other individual, without restriction.

If we share your Personal Information with any third party not described in this Privacy Policy, we will notify you before we share your Personal Information with any third parties, and you will be able to prevent the sharing of this information.

We will not otherwise distribute, sell, rent, transfer, or otherwise disclose your Personal Information, including without limitation, Personal Photos, to any third party, except as provided for in this Privacy Policy or with your consent.

Information You Share. Our Websites, Apps, and Services allow you to connect and share content and information. Please be mindful of your own privacy needs as you choose who to connect with and what to share and make public. We cannot control the privacy or security of information you choose to make public on the Websites or through the optional integration with Third-Party Services. If you share information about others, we suggest you get consent for any information you may share about them

Public Profile. Certain portions of the information you provide to us may also be displayed in your profile. Your profile is not public, but may be viewed by other users of the Apps and/or Websites. Content you post to the Websites is also meant for public consumption. We may display this content on the Websites, and further distribute it to a wider audience through third-party sites and services. Once displayed on publicly viewable web pages and/or Third-Party Services, that information can be collected and used by others. We cannot control who reads your posting or what other users may do with the information that you voluntarily post, so it is very important that you do not put personal information in your posts. Once you have posted information publicly, while you will still be able to edit and delete it on the Services, you will not be able to edit or delete such information cached, collected, and stored elsewhere by others (e.g., search engines).

How Long Do We Retain Your Personal Information?

We retain your Personal Information, User Content and other information stored and collected through our Services for as long as we have a business or tax need or as applicable laws, regulations, or government orders require. When your information is no longer necessary or relevant for the identified purpose or to fulfill a legal or business requirement, we will use reasonable commercial efforts to securely dispose of and destroy your information collected through the Services.

After expiry of the applicable retention periods, your Personal Information will be deleted. If there is any information that we are unable, for technical reasons, to delete entirely from our systems, we will put in place appropriate measures to prevent any further use of such Information.

We will keep any Aggregate Information and Non-Personal Information indefinitely.

Is My Information Secure?

We take your privacy seriously. After receiving your Personal Information, we will store it on our servers for future use. We have physical, electronic, and managerial procedures in place to safeguard and help prevent unauthorized access, maintain data security, and correctly use the information we collect.  Unfortunately, no data transmission over the internet or data storage solution can ever be completely secure. As a result, although we take industry-standard steps to protect your information, we cannot ensure or warrant the security of any information you transmit to or receive from us or that we store on our or our service providers’ systems.

The safety and security of your Personal Information can also depends on you. Where we have given you (or where you have chosen) a password for access to certain parts of our Services, you are responsible for keeping this password confidential. We ask you not to share your password with anyone and you agree not to provide any other person with access to the Services or portions of it using your name, password or other security information. You agree to notify us immediately of any unauthorized access to or use of your username or password or any other breach of security. We have the right to disable any username, password or identifier, whether chosen by you or provided by us, at any time in our sole discretion for any or no reason, including, if, in our opinion, you have violated any provision of this Privacy Policy.

How Do I Opt Out, Update, or Delete My Information?

You may opt-out of receiving promotional emails by e-mailing at privacy@newmanministry.com. When you use our Services, we work to provide you the ability to access, review, correct, edit, or remove your Personal Information and related content that you have provided to us. If you have created an account, you can do this by logging into the Services and visiting your account profile page. You may also send us an e-mail at privacy@newmanministry.com or write to us at Newman Ministry, 1700 Pacific Ave., Suite, 2420, Dallas, TX 75201, to request access to, correct or delete any Personal Information that you have provided to us. Please include your name and any other identifiable information necessary, so that we may locate your information. Under certain privacy laws you may have a right to access your Personal Information that we hold about you, however, your rights to access your Personal Information are not absolute. We may decline to process requests that are unreasonably repetitive or systematic, require disproportionate technical effort, jeopardize the privacy of others, or would be extremely impractical. In addition, we may not accommodate a request to access or change information if we believe the change would violate any law or legal requirement or cause the information to be incorrect. If we deny your request for access to, or refuse a request to correct Personal Information, we shall explain why. For your information, removal of your Personal Information may impact our ability to provide you or your ability to use our Services.

Please include your name and any other identifiable information necessary, so that we might locate your information. If we have sent you a promotional e-mail, you may send us a return e-mail asking to be omitted from future e-mail distributions.

How We Respond to Do Not Track Signals. We do not currently respond to “do not track” signals or other mechanisms that might enable consumers to opt out of tracking on our Websites.

EEA Privacy Rights

If you are an individual who resides in the United Kingdom, the European Economic Area, or Switzerland (collectively, and for the purposes of this Privacy Policy, the “EEA”), this Privacy Policy may be subject to the provisions of the EU General Data Protection Regulation (“EU GDPR”) and the UK General Data Protection Regulation (“UK-GDPR”, and together with the EU GDPR, the “GDPR”). Under the GDPR, Newman is a data “Controller”. If you are an individual of the EEA, you are a “Data Subject” with certain protected privacy rights concerning your personal information.  We will take commercially reasonable steps to maintain compliance with GDPR. The GDPR requires that we, in our capacity as a Controller, have at least one legal basis to process your PII.

  • To perform the contract that we are about to enter with you (e.g., our Terms of Use);

  • The right to be informed. This is your right to be informed about what we are processing, why, and who else the data may be passed to.
  • The right of access. This is your right to see what data about you is held by us.
  • The right to rectification. This is the right to have your data corrected or amended if what is held is incorrect in some way.
  • The right to be forgotten. This is the right to have your personal information to be deleted in the event that such data is no longer required for the purposes it was collected for, your consent for the processing of the data is withdrawn, or the data is being unlawfully processed.
  • The right to restrict processing. This is the right to ask for a temporary halt to processing of your personal information, such as in the case where a dispute or legal case has to be concluded, or the data is being corrected.
  • The right to data portability. This is the right to ask for your personal information to be provided to you in a structured, commonly used, and machine-readable format.
  • The right to object. This is the right to object to further processing your personal information if such processing is inconsistent with the primary purposes for which it was collected.
  • Right in relation to automated decision making and profiling. This is the right to not be subject to a decision based solely on automated processing. The Service does not engage in automated decision making or profiling.

California Privacy Rights.

California law allows California residents to request information regarding our disclosures in the prior calendar year, if any, of their personally identifiable information to third parties. To make such a request, please contact us at privacy@newmanministry.com with “Request for Privacy Information” in the subject line. Please include enough detail for us to locate your file; at a minimum, your name, email, and username, if any. We will attempt to provide you with the requested information within thirty (30) days of receipt. We reserve our right not to respond to requests sent more than once in a calendar year, or requests submitted to an address other than the one posted in this notice. Please note that this law does not cover all information sharing. Our disclosure only includes information covered by the law.

Nevada Privacy Rights.

If you are a Nevada resident, we do not “sell” your “covered information” as such terms are defined in the Nevada Privacy of Information Collected on the Internet from Consumers Act as amended by Nevada Revised Statutes Chapter 603A (“Nevada Privacy Law” or “NPL”). Though we do not sell your covered information, as someone that is subject to the NPL, you have a right of access in relation to the covered information of yours that we have or process, including why we process it, and other parties with whom we may share such information.  If you would like to tell us not to sell your information in the future, please email us at privacy@newmanministry.com with your name, postal address, telephone number, and email address with “Nevada Do Not sell” in the subject line.

Other Privacy Concerns.

Children’s Privacy. We are committed to protecting the privacy of children and encourage parents and guardians to take an active role in their children’s online activities and interests. Our Services are not directed to children or designed to attract them. You must be at least 13 years of age to use our Services. We do not knowingly collect, use, or disclose Personal Information about users that are under 13 years of age. If we later learn that a user is under 13 years of age, we will remove that user’s Personal Information from our databases and prevent the user from further using our Services.

Users Outside of the United States

If you are a non U.S. user of the Services, by using our Services, you acknowledge and agree that your personal information may be processed for the purposes identified in the Policy. In addition, your personal information may be processed in the country in which it was collected and in other countries, including the United States, where laws regarding processing of personal information may be less stringent than the laws in your country. By providing your data, you consent to such transfer.

Monitoring and Enforcement.

In accordance with applicable laws, you may request access and raise concerns or complaints regarding your Personal Information processed by us with by contacting us: by email at privacy@newmanministry.com.

If you file a complaint, we will investigate the matter or suspected failure to comply with this Privacy Policy. It is our practice to respond to you within 45 days of receiving the complaint. We will take all appropriate action to remedy any such issues.
